AGREEMENT TO Consent to receive Schedule K-1 Electronically

By accessing and using the Website, you (the “Recipient”) consent, without qualification, to receive K-1’s electronically (the "Consent") via this Website or e-mail, if specifically requested, from New Harbor Capital LLC (the "Firm"), on behalf of all Firm investment partnerships.  This Consent will be valid until the Recipient requests a withdrawal of the Consent.  If you do not agree, please do not use or access the Website.

Disclosure Statement

This Consent to receive Schedule K-1 electronically is designed to be in accordance with Rev. Proc. 2012-17, I.R.B. 2012-10.

TERMS FOR PROVIDING SCHEDULE K-1 ELECTRONICALLY

     A.  Paper statement. To the extent any user of the Website does not consent; a paper copy of Schedule K-1 will be mailed.

     B.  Scope and duration of Consent. This Consent applies to each Schedule K-1 until a formal request to withdraw the Consent is received by the Firm.   

     C.  Withdrawal of Consent.

(1)  The Recipient may withdraw the Consent in writing or via E-mail to:

(2)  The withdrawal of Consent will be effective either on the date it is received by the Firm or on a subsequent date determined by the Firm and communicated to the Recipient within a reasonable period of time after the Firm receives the withdrawal.

(3)  The Firm will confirm the withdrawal and the date on which it takes effect in writing (either electronically or on paper).

(4)  A withdrawal of the Consent does not apply to a Schedule K-1 that was furnished electronically to the Recipient before the date on which the withdrawal of consent takes effect.

     D.  Consent termination. This Consent will terminate upon the Recipient's withdrawal from the Firm or upon a dissolution or termination of the Firm. 

     E.  Updating information. The Recipient must inform the Firm of any updated contact information, including e-mail address, mailing address and phone number, as soon as possible by sending an e-mail to Michelle Karlin at mkarlin@chsonline.com.  Additionally, the Firm will send an e-mail to inform the Recipient of any change in Firm’s contact information using the e-mail address on file for the Recipient. 

     F.   Hardware and software requirements.  Access to the Internet, your email address and Adobe®Reader® is required to access, print and retain the Schedule K-1.  The Schedule K-1 may be required to be printed and attached to a Federal, State, or local income tax return.
